莫斯科法院判决电商平台须向误购消费者退款，拒退行为被认定违法

<div class="ce-paragraph cdx-block ce-paragraph--left">莫斯科一家地方法院近日作出裁决，认定某电商平台拒绝向一位因未成年子女误操作下单、且在商品发货前申请取消订单的消费者退还货款的行为违法，判令平台必须全额返还买家被扣除的款项并消除其账户产生的负面余额；法院指出，消费者在商品进入物流配送前提出撤销购买意愿属合法权利，平台以"已转入拣货"为由单方拒退缺乏法律依据，此判决进一步明确俄罗斯司法实践中对远程交易撤销权及平台附随退款义务的从严解释，提示在俄运营的跨境电商及本土平台需完善订单即时取消机制，避免因不当扣留消费者预付款而面临个体诉讼及监管部门追责风险。</div>
